1. About these terms
1.1 These terms apply to the RCP Care Plan provided by Remote Control Parts Pty Ltd (ABN 21 684 936 730) (RCP, we, us) to the customer named on the plan (you).
1.2 You accept these terms when you sign up to a plan, pay for a plan, or send a remote in under a plan. We record the version of the terms you accepted and the date.
1.3 In these terms: Plan means an RCP Care Plan for one or more Covered Remotes; Covered Remote means a radio remote control transmitter listed on your plan by make, model and serial number; Tier means the Pushbutton or Bellybox tier that applies to a Covered Remote; Plan Year means each 12-month period starting on the plan start date; Service means the annual service described in clause 5; Wear Kit means the set of wear parts we nominate for a remote model, such as buttons, rubber boots, seals and the battery; and Business Day means a weekday that is not a public holiday in New South Wales.
1.4 Prices are in Australian dollars and exclude GST unless stated otherwise.
2. Plans, tiers and eligibility
2.1 A plan covers each Covered Remote listed on it. The price is per Covered Remote and depends on its Tier.
2.2 There are two Tiers: Pushbutton (handheld pushbutton transmitters) and Bellybox (bellybox and joystick transmitters).
2.3 We decide which Tier applies to a remote. If a remote could fit either Tier, we will tell you before you sign up.
2.4 A remote can be added to a plan only if it is in serviceable condition. We may inspect it first. If it needs repair, we will quote the repair, and the remote is covered only once the repair is done and paid for.
2.5 We may cover remotes we did not supply, including other brands, at our discretion. We may decline a remote if parts are not reasonably available.
2.6 A plan covers the transmitter only. Receivers, machine wiring and on-site work are not covered.
3. Payment
3.1 You can pay for a plan monthly, in advance, by card; or annually, in advance, at a 10% discount on the plan price.
3.2 If we have approved you for a trade account, we may invoice you instead, on your account’s payment terms.
3.3 Card payments are processed by Stripe. We do not store your card details.
3.4 If a payment fails, we will try again and tell you by email. If it is still unpaid 14 days after the due date, your plan is suspended. While suspended, your remotes are not covered and the member discount does not apply.
3.5 A suspended plan resumes once all overdue amounts are paid. We may cancel a plan that stays suspended for more than 60 days.
3.6 You will receive a tax invoice for each payment.
4. Term, renewal and cancellation
4.1 Monthly plans have a minimum term of 12 months. After that they continue month to month until cancelled.
4.2 Annual plans run for 12 months and renew automatically for another 12 months. We will email you at least 30 days before each renewal, with the renewal price.
4.3 You can cancel by giving us 30 days’ written notice by email to [email protected].
4.4 When a plan ends or is cancelled: (a) any Service not yet performed in the current Plan Year is forfeited; (b) payments already made are not refunded; and (c) the member discount ends.
4.5 If the Service for the current Plan Year has already been performed and you cancel a monthly plan before 12 monthly payments for that Plan Year have been made, the remaining monthly payments for that Plan Year become payable.
4.6 We may cancel a plan by giving you 30 days’ written notice. If we do, we will refund any amount you paid in advance for a period after the cancellation date, and any Service not yet performed in the current Plan Year will be refunded pro rata.
4.7 Nothing in this clause limits any right you have under the Australian Consumer Law or the New Zealand Consumer Guarantees Act that cannot be excluded.
5. What’s included
5.1 Each Covered Remote receives one Service per Plan Year. The Service includes: (a) inspection of the housing, buttons, joysticks, switches, antenna and charger contacts; (b) cleaning of the housing and contacts; (c) fitting the Wear Kit parts that need replacing, at no charge for those parts or the labour; (d) a functional and safety test, including emergency stop operation and stop time, range, battery condition, and that every button and function operates its correct output against the configuration we hold for that remote; (e) a firmware check and update where the manufacturer provides one; and (f) a written service report, emailed to you and kept on file.
5.2 Freight both ways for the Service is included. We email you a prepaid courier label for sending the remote in, and we pay for its return.
5.3 We will remind you by email before each Service is due. You need to send the remote in during the Plan Year. A Service not taken in a Plan Year does not carry over to the next.
6. What’s not included
6.1 The plan does not cover, and we will quote separately for: (a) accidental or impact damage, such as drops, crushing or a cracked housing; (b) water, chemical or dust ingress beyond the remote’s rated protection; (c) misuse, neglect, or use outside the manufacturer’s instructions; (d) modifications or repairs by anyone other than RCP; (e) parts that are not in the Wear Kit, such as circuit boards, joysticks and displays; (f) additional batteries and chargers; (g) lost or stolen remotes; (h) receivers, machine wiring, and any on-site attendance; and (i) faults that arise between Services.
6.2 Work outside the plan is charged at our normal rates, less the member discount in clause 10.1.
7. Sending remotes in
7.1 To book a Service, reply to your reminder email or contact us. We will email you a prepaid courier label and a service request form.
7.2 Pack the remote securely, include the printed service request form, and attach the label. Do not send receivers, cables or chargers unless we ask for them.
7.3 Before sending a remote in, you must take it out of service and make sure the machine it controls is safely isolated or operated by another means. You are responsible for arranging a spare or backup remote if you need one while yours is with us.
7.4 The remote is at our risk while it travels on our prepaid label and while it is with us. If it is lost or damaged by the courier, we will repair or replace it.
7.5 Remotes sent without our label, or packed in a way that causes damage, are at your risk in transit.
8. Turnaround
8.1 We will complete the Service and dispatch the remote within 7 Business Days of receiving it.
8.2 The 7 Business Days do not include time spent waiting for: (a) your approval of a quote for work outside the plan; (b) parts outside the Wear Kit that we need to order; or (c) information we need from you, such as configuration details.
8.3 If we expect a delay, we will tell you as soon as we know, with a new expected date.
9. Safety test results
9.1 If a remote fails the safety test, we will tell you why and quote the repair at our normal rates, less the member discount.
9.2 If you approve the quote, we repair the remote, test it again, and return it with a passed service report.
9.3 If you decline the quote, we return the remote marked as failed, with a service report stating that it failed and must not be used until repaired.
9.4 The safety test checks the remote at the time of testing only. It is not a guarantee that the remote, the receiver or the machine will operate safely afterwards.
9.5 You remain responsible for pre-use checks, operator training, and the safe operation of your equipment under work health and safety law.
10. Member discount, changes to your plan, and price changes
10.1 Member discount. While your plan is active and paid up, you receive 5% off our normal prices for parts and for repairs outside the plan. The discount does not apply to plan payments, freight outside the plan, or items already on sale.
10.2 Adding and removing remotes. You can add remotes to your plan at any time, subject to clause 2.4. The price is adjusted pro rata from the date the remote is added. You can remove a remote by giving 30 days’ written notice; clause 4.4 then applies to that remote as if its cover were cancelled.
10.3 Price changes. We may change plan prices by giving you at least 30 days’ written notice. For annual plans, a new price applies from your next renewal. For monthly plans, it applies from the first payment after the notice period ends. If you do not accept a price change, you may cancel before it takes effect, without the minimum term in clause 4.1 applying.
10.4 Changes to these terms. We may update these terms by giving you at least 30 days’ written notice. If a change is to your detriment, you may cancel before it takes effect, on the same basis as clause 10.3.
11. Liability, consumer law, privacy and general
11.1 Consumer law. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded.
11.2 Limit of liability. To the extent the law allows, our liability for a failure to comply with a guarantee, or for any other claim in connection with the plan, is limited to supplying the Service again or paying the cost of having it supplied again. We are not liable for indirect or consequential loss, including loss of production, downtime, or loss of profit.
11.3 New Zealand customers. If you acquire the plan for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply to the extent permitted by section 5D of that Act.
11.4 Privacy. We keep records of your Covered Remotes, their configuration, and their service history to provide the plan. We share payment details with Stripe and accounting records with Xero. We handle personal information under our privacy policy.
11.5 Notices. We may send notices to the email address on your plan. You may send notices to [email protected].
11.6 Governing law. These terms are governed by the laws of New South Wales, Australia. Each party submits to the courts of New South Wales.
